1. Acceptance of Terms

Welcome to Rise Reformer Pilates & Wellness (“Rise,” “we,” “us,” or “our”).

By booking, attending, or participating in any Rise class, session, event, or membership (collectively the “Services”), you agree to these Terms & Conditions (“Terms”). If you do not agree, please refrain from using our Services.

These Terms apply to all use of our in-studio classes, online programs, and our website located at capecoralpilates.com.

2. Eligibility & Health Commitment

You must be at least 18 years old to participate, or have written consent from a parent or guardian if under 18.

By joining any Rise class or program, you represent that:

  • You are in good physical condition and have consulted a physician regarding any health concerns, injuries, or conditions that could affect participation.

  • You understand that Pilates and other physical exercise carry inherent risks of injury, and you voluntarily assume those risks.

  • You agree to inform your instructor of any limitations, injuries, pregnancy, or recent surgeries before class.

Rise Reformer Pilates is not responsible for personal injury, illness, or aggravation of pre-existing conditions. Please practice mindfully and within your limits.

3. Booking & Payments

  • All classes, sessions, and memberships must be booked and paid for through our approved booking platform (e.g., Mariana Tek).

  • Payment is required at the time of booking.

  • Cancellation Policy: Classes must be canceled at least 8 hours before the start time to avoid forfeiting the session or incurring a late-cancel fee. No-shows will be charged in full.

  • Class packages and memberships may have expiration dates, which are displayed at purchase. Expired credits cannot be refunded or extended unless required by law.

  • We reserve the right to change class times, instructors, or prices at any time. Substantial changes will be communicated in advance when possible.

4. Memberships & Renewals

If you purchase a recurring membership:

  • Your payment method will be charged automatically according to your plan (monthly, bi-monthly, etc.).

  • You may cancel or pause your membership by giving written notice at least 30 days before your next billing date.

  • Memberships are non-transferable and non-refundable, except where required by law.

  • Promotional “Founders Special” rates are valid only for the period and conditions specified at purchase.

5. Studio Etiquette & Client Conduct

We strive to create a welcoming, safe environment for everyone. You agree to:

  • Arrive on time and check in before class.

  • Silence cell phones and avoid disruptions during class.

  • Use equipment properly and follow instructor directions.

  • Refrain from abusive, unsafe, or disrespectful behavior.

Rise reserves the right to refuse service or terminate memberships for misconduct or repeated policy violations.

6. Liability Waiver

By participating in any Rise service, you acknowledge and agree that:

  • You voluntarily assume all risks associated with physical exercise and studio participation.

  • To the fullest extent permitted by law, you release and hold harmless Rise Reformer Pilates, its owners, instructors, employees, agents, and contractors from any and all claims, damages, or causes of action arising from your participation, use of equipment, or presence at the studio—whether caused by negligence or otherwise.

  • You are responsible for any personal property brought to the studio; Rise is not liable for lost or stolen belongings.

If any part of this waiver is deemed invalid, the remaining provisions shall remain enforceable.

7. Intellectual Property & Content

All materials on our website, social media, and in-studio (including text, logos, photos, videos, and designs) are the property of Rise Reformer Pilates or its licensors. You may not reproduce, distribute, or use them without written permission.

Recording classes or instructors without prior consent is strictly prohibited.

8. Online Services & Accounts

If you create an account on our website or booking platform, you agree to maintain accurate information and keep your login credentials secure. You are responsible for all activity under your account.

We may suspend or terminate accounts that violate these Terms or misuse our website or systems.

9. Promotions & Communications

By providing your contact information, you consent to receive transactional communications (class confirmations, schedule updates, etc.).

You may also opt-in to receive marketing messages by email or text. You can unsubscribe at any time by following the prompts or contacting us directly.

10. Refunds & Transfers

All sales are final unless otherwise stated. Refunds may be granted at our discretion in cases of documented medical issues or verified billing errors.

Class credits, memberships, or promotional offers may not be sold, shared, or transferred.

11. Changes to Services or Terms

We may modify our class schedule, pricing, or policies at any time. If we make significant changes to these Terms, we’ll post the updated version on our website and update the “Effective Date.” Continued use of our Services after such notice constitutes acceptance.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida. Any disputes arising under or related to these Terms shall be resolved exclusively in the state or federal courts located in [Lee County], Florida.

13. Severability & Entire Agreement

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force. These Terms, together with our Privacy Policy and any other written agreements, represent the entire understanding between you and Rise Pilates & Wellness.
